2. Definitions
Firstmark means FIRSTMARK VEHICLE GROUP. Customer means the person or business enquiring about or purchasing a vehicle. Consumer means an individual acting wholly or mainly outside their trade, business, craft or profession. Business Buyer means a customer purchasing wholly or mainly for business purposes. Vehicle means the used vehicle advertised or being discussed. Deposit means a sum paid to reserve a Vehicle; a Reservation Fee is a deposit taken online or by telephone to hold a Vehicle. Contract means the agreement for the sale of a Vehicle. Website means this Firstmark website. Transaction means any purchase, sale or related agreement between Firstmark and a Customer.
3. Vehicle Advertisements
Vehicle descriptions, specifications, images and other information on the Website are intended to be accurate. Customers should check specifications, images and descriptions carefully before purchase, and raise any queries with Firstmark. Any errors identified will be corrected promptly.
Advertised prices are the full price payable for the Vehicle and include any mandatory fees. Firstmark does not add compulsory admin or other charges on top of an advertised price.
4. Used Vehicle Condition
Used vehicles can show age-related wear, mileage-related wear, cosmetic imperfections, previous repairs and other normal characteristics of a used vehicle. This is a feature of buying a used vehicle and does not remove or reduce a Consumer's statutory rights.
5. Vehicle Inspection
Customers are encouraged to inspect the Vehicle, ask questions, review documentation, take a test drive where offered, and raise any concerns before purchase. Inspection does not remove statutory rights.
6. Warranties
No additional dealer warranty is currently offered unless expressly stated for a particular Vehicle. This does not affect any statutory rights that apply to the Customer.
7. Returns & Refunds
Firstmark does not offer voluntary change-of-mind returns unless expressly stated in writing. Consumer statutory rights in respect of faulty, misdescribed or otherwise non-conforming vehicles remain fully applicable; the available remedies depend on the circumstances and applicable law. This clause is subject to section 8a (Distance Sales).
Statutory consumer rights
Under the Consumer Rights Act 2015, vehicles sold to consumers must be of satisfactory quality, taking into account the vehicle's age, mileage and price. Normal wear and age-related imperfections consistent with a used vehicle of that description are not faults.
Where a vehicle does not conform to the Contract, a Consumer may, subject to the Act:
- exercise the short-term right to reject within 30 days of delivery for a full refund;
- between 30 days and six months, require one repair or replacement, and if that fails, obtain a refund (which may reflect fair use of the vehicle) or a price reduction.
These rights are in addition to, and do not replace, any other statutory rights the Consumer may have.
8. Deposits
A Deposit reserves the Vehicle and demonstrates the Customer's commitment to proceed. Where a Customer simply changes their mind, the Deposit may be treated as non-refundable, subject to applicable law and the circumstances of the particular Transaction. This is subject to section 8a (Distance Sales).
A Customer may be entitled to recover a Deposit — for example, where Firstmark cancels the Transaction, where the Vehicle is materially misdescribed, or where the Vehicle is not made available as agreed. Any amount retained by Firstmark will be proportionate and fair.
8a. Distance Sales
Where a Consumer purchase or reservation is concluded entirely at a distance — online or by telephone, without the Customer visiting Firstmark in person at any point — the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give the Consumer a 14-day right to cancel without giving a reason. In that event, the Consumer is entitled to a full refund, including any reservation payment.
Firstmark will provide the legally required cancellation information before the Contract is made. This 14-day cancellation right does not generally apply where the Customer visits in person to complete the purchase. Section 8 (Deposits) is subject to this section 8a for distance sales.
9. Payment
Payment arrangements will be confirmed before completion. Cleared funds may be required before handover of the Vehicle. Firstmark does not currently offer consumer finance.
10. Test Drives
Test drives may be offered subject to availability and business policy. A valid UK driving licence and appropriate insurance requirements apply. Firstmark may reasonably refuse a test drive.
11. Vehicle Documentation
V5C, MOT, service history, receipts and the number of keys will be discussed on a per-vehicle basis. Nothing is guaranteed until verified in writing for the specific Vehicle.
12. Vehicle Tax & Registration
Responsibilities for vehicle tax and registration depend on the Transaction and applicable DVLA rules. Accurate information will be provided for the Vehicle being sold.
13. Business Sales
Different legal rights may apply to purchases made wholly or mainly for business purposes. Consumer-specific rights do not apply to Business Buyers.
14. Liability & General
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
